- Website means You in a Story, accessible from https://youinastory.com.
- You means the individual accessing or using the Service.
- Goods means the personalised books offered for sale on the Service.

Acknowledgment
These are the Terms governing the use of the Service and the agreement that operates between You and the Company. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. By accessing or using the Service You agree to be bound by them. If You disagree with any part of these Terms You may not access the Service.
You represent that You are over the age of 18, and that You are able to enter into a binding contract. The Company does not permit those under 18 to use the Service.
Your use of the Service is also conditioned on Your acceptance of Our Privacy Policy, which describes Our policies and procedures on the collection, use and disclosure of Your personal information, including the information You provide about a child.
Orders and personalisation
The Goods are made to order. You personalise a book by entering a child's first name and other details and by uploading photographs, and We generate a book from them.
You review and approve every page before payment is taken. Your approval determines what is printed, including the spelling of any name. By placing an Order You warrant that the details You have supplied are complete and accurate.
Illustrations are generated for Your book and will differ from the examples shown on the Website. An illustration of a child is an interpretation and not a photographic likeness.
We reserve the right to refuse or cancel any Order at Our discretion, including where Goods are unavailable, where an error in the description or price is found, or where the Order appears to be fraudulent. Where We cancel, We will refund You in full.
Your content and permissions
The photographs and details You upload remain Yours. You grant the Company a limited licence to store, transmit and process them for the sole purpose of producing, printing and delivering the book You have ordered, including by sharing them with the service providers described in the Privacy Policy.
You represent and warrant that You are the parent or legal guardian of any child shown, or that You have that person's permission, and that You have all rights necessary to grant this licence. You agree to indemnify the Company against any claim arising from a breach of this warranty.
The Company will not use Your photographs or Your child in its own marketing without Your separate written permission.
AI-assisted illustration
Each book carries the following disclosure, and You acknowledge it when You place an Order: "Written by people. Illustrated with the help of AI in our house styles, and checked page by page by you."
The text of each book is written by people. The illustrations are generated with the assistance of AI models and are checked page by page by the customer before printing.
Prices and payment
Prices are displayed in the currency of the shop You are viewing and are the prices payable at checkout. Shipping for printed books is charged at the rate shown at checkout before You pay, less any discount code You apply.
Prices may be changed at any time before Your Order is accepted. Where a price is listed incorrectly We will notify You before taking payment and You may cancel. Import duties or other charges levied on a cross-border delivery are not included and are Your responsibility.
Payment is taken at the time You approve and place Your Order, by the methods offered at checkout, and is processed by Our payment processor.
Cancellations and refunds
- Before Your book has been sent to print: contact Us and We will cancel the Order and refund You in full.
- After printing has begun but before dispatch: We will stop the delivery where We can, but the cost of printing has been incurred and any refund will be partial.
- After dispatch: the Order cannot be cancelled. Faulty or damaged Goods are covered below.
To cancel, write to hello@youinastory.com as soon as possible. Books are sent to print promptly after approval.
Because the Goods are made to Your specification and personalised to a named child, the statutory right to cancel a distance contract within 14 days does not apply to them. This is the law's own exception for bespoke goods and it does not affect Your rights in respect of faulty Goods.
Delivery
Books are typically made and dispatched within five to seven days, after which delivery times depend on the carrier and the destination. Any delivery date We give is an estimate and not a guarantee, and We are not liable for delays caused by circumstances outside Our reasonable control.
You are responsible for providing an accurate delivery address. Where an Order is undeliverable because the address supplied was incorrect, a replacement is a new Order.
Defective or damaged Goods
If Your book arrives damaged, misprinted, incomplete, or materially different from the book You approved, email hello@youinastory.com within 30 days of delivery with photographs and Your order details. We will reprint or refund the Order at Your election, at no cost to You.
Nothing in these Terms affects Your statutory rights as a consumer under the law of the country in which You reside, including the Consumer Rights Act 2015 in the United Kingdom, the Australian Consumer Law, the Consumer Guarantees Act 1993 in New Zealand, and applicable consumer legislation in Canada and the United States. Where these Terms conflict with those rights, those rights prevail.
Intellectual property
The Service, and the stories, illustrations, designs and software comprising it, are and remain the exclusive property of the Company and its licensors. The physical book You purchase is Yours, for personal, non-commercial use. You may not reproduce it commercially, resell copies of it, or use its contents to train any model.
Prohibited uses
You agree not to use the Service to submit or request:
- Photographs of a child over whom You have no parental or guardian authority and no permission.
- Any sexual content involving a child. Such material is scanned for, preserved and reported to the appropriate authority.
- Content that is unlawful, hateful, harassing, defamatory, or that infringes another person's rights.
- Content impersonating another person, or using another person's likeness without permission.
You further agree not to attempt to gain unauthorised access to the Service, to scrape it, or to interfere with its operation.
Links to other websites
The Service may contain links to third-party websites that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content or practices of any third-party site, and We advise You to read the terms and privacy policy of any site You visit.
Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, if You breach these Terms. Upon termination Your right to use the Service ceases immediately. Where We terminate while an Order is in progress We will either complete that Order or refund it.
You may stop using the Service at any time and may delete the content You have uploaded, as described in the Privacy Policy.
Limitation of liability
To the maximum extent permitted by applicable law, the total liability of the Company under any provision of these Terms is limited to the amount You actually paid for the Order giving rise to the claim.
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental or consequential damages, including loss of profits, loss of data, or a gift not arriving in time for an occasion. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
"AS IS" and "AS AVAILABLE" disclaimer
The Website is provided to You "AS IS" and "AS AVAILABLE" and without warranty of any kind. The Company does not warrant that the Website will be uninterrupted, error-free, or free of harmful components. This disclaimer applies to the Website and not to the Goods, which are covered by "Defective or damaged Goods" above and by Your statutory rights.
Governing law
The laws of the State of Delaware, United States, excluding its conflicts of law rules, govern these Terms and Your use of the Service.
Disputes resolution
If You have a concern or dispute about the Service, You agree first to try to resolve it informally by contacting the Company at hello@youinastory.com.
For consumers outside the United States
If You are a consumer resident outside the United States, the choice of law above does not deprive You of the protection afforded by the mandatory consumer law of the country in which You reside, and You may bring proceedings in Your local courts.
If You are a consumer in the European Union, You benefit from any mandatory provisions of the law of the country in which You are resident.
United States legal compliance
You represent that You are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that You are not listed on any United States government list of prohibited or restricted parties.
Severability and waiver
If any provision of these Terms is held to be unenforceable or invalid, it will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise that right at any time thereafter, nor shall a waiver of a breach constitute a waiver of any later breach.
Translation interpretation
These Terms may have been translated. You agree that the original English text shall prevail in the case of a dispute.
Changes to these Terms
We reserve the right to modify or replace these Terms at any time. Where a revision is material We will make reasonable efforts to provide notice before it takes effect. The Terms that apply to an Order are those published at the time the Order was placed. By continuing to use the Service after a revision takes effect You agree to be bound by the revised Terms.
